Berbersmudge cares greatly about your privacy. We therefore only process data that we need for (improving) our services and handle the information we have collected about you and your use of our services with care. We never make your data available to third parties for commercial purposes.

This privacy policy applies to the use of the website and the services provided through it by Berbersmudge. The effective date of these terms is 28/11/2022. With the publication of a new version, the validity of all previous versions expires. This privacy policy describes which data we collect about you, what these data are used for, and with whom and under what conditions these data may be shared with third parties. We also explain how we store your data, how we protect your data against misuse, and what rights you have regarding the personal data you provide to us.

Below you can read how we process your data, where we store it, which security techniques we use, and who has access to the data.

Webshop Software

WooCommerce

Our webshop has been developed using WooCommerce software. Personal data that you make available to us for the purpose of our services are shared with this party. WooCommerce has access to your data in order to provide us with (technical) support, and they will never use your data for any other purpose. Based on the agreement we have entered into with them, WooCommerce is obliged to take appropriate security measures. These security measures consist of the use of SSL encryption and a strong password policy. WooCommerce uses cookies to collect technical information regarding your use of the software; no personal data are collected and/or stored. WooCommerce reserves the right to share collected data within its own group in order to further improve its services.

WooCommerce Hosting

Our webshop has been developed using WooCommerce software, and for our web hosting we have chosen MijnDomein. Personal data that you make available to us for the purpose of our services are shared with this party. MijnDomein has access to your data in order to provide us with (technical) support, and they will never use your data for any other purpose. Based on the agreement we have entered into with them, MijnDomein is obliged to take appropriate security measures. These security measures consist of the use of SSL encryption and a strong password policy. Backups are made regularly to prevent data loss.

Web Hosting

Flexweb Hosting

We purchase web hosting and email services from Flexweb Hosting. Flexweb Hosting processes personal data on our behalf and does not use your data for its own purposes. However, this party may collect metadata about the use of the services. These are not personal data. Flexweb Hosting has taken appropriate technical and organizational measures to prevent loss and unauthorized use of your personal data. Flexweb Hosting is bound by confidentiality under the agreement.


Email and Mailing Lists

MailChimp

We send our email newsletters through MailChimp. MailChimp will never use your name and email address for its own purposes. At the bottom of every email sent automatically through our website, you will see the “unsubscribe” link. You will then no longer receive our newsletter. Your personal data are securely stored by MailChimp. MailChimp uses cookies and other internet technologies that make it possible to see whether emails are opened and read. MailChimp reserves the right to use your data to further improve its services and, in that context, to share information with third parties.

Flexweb Hosting

We use the services of Flexweb Hosting for our regular business email traffic. This party has taken appropriate technical and organizational measures to prevent misuse, loss, and corruption of your and our data as much as possible. Flexweb Hosting does not have access to our mailbox, and we treat all our email traffic confidentially.


Payment Processors

Mollie

For handling (part of) the payments in our webshop, we use the Mollie platform. Mollie processes your name, address, place of residence details, and your payment details such as your bank account or credit card number. Mollie has taken appropriate technical and organizational measures to protect your personal data. Mollie reserves the right to use your data to further improve its services and, in that context, to share (anonymized) data with third parties. All of the above-mentioned safeguards regarding the protection of your personal data also apply to the parts of Mollie’s services for which it engages third parties. Mollie does not retain your data longer than is permitted by the legal retention periods.


Reviews

WebwinkelKeur

We collect reviews through the WebwinkelKeur platform. If you leave a review through WebwinkelKeur, you are required to provide a name and email address. WebwinkelKeur shares these data with us so that we can link the review to your order. WebwinkelKeur also publishes your name on its own website. In some cases, WebwinkelKeur may contact you to ask for clarification regarding your review. If we invite you to leave a review, we share your name and email address with WebwinkelKeur. They use these data solely for the purpose of inviting you to leave a review. WebwinkelKeur has taken appropriate technical and organizational measures to protect your personal data. WebwinkelKeur reserves the right to engage third parties for the purpose of providing its services, for which we have given WebwinkelKeur permission. All of the above-mentioned safeguards regarding the protection of your personal data also apply to the parts of the service for which WebwinkelKeur engages third parties.


Shipping and Logistics

PostNL

If you place an order with us, it is our task to have your package delivered to you. We use the services of PostNL to carry out deliveries. For this purpose, it is necessary that we share your name, address, and place of residence details with PostNL. PostNL uses these data solely for the purpose of executing the agreement. If PostNL engages subcontractors, PostNL will also make your data available to these parties.

DHL

If you place an order with us, it is our task to have your package delivered to you. We use the services of DHL to carry out deliveries. Instagram and Facebook

We sell (part of) our products through the Instagram and Facebook platforms. If you place an order via these platforms, Instagram and Facebook share your order and personal data with us. We use these data to process your order. We treat your data confidentially and have taken appropriate technical and organizational measures to protect your data against loss and unauthorized use.


Purpose of Data Processing

General Purpose of Processing

We use your data exclusively for the purpose of our services. This means that the purpose of the processing always directly relates to the assignment you provide to us. We do not use your data for (targeted) marketing. If you share data with us and we use these data to contact you at a later time — other than at your request — we will ask for your explicit consent. Your data will not be shared with third parties other than to comply with accounting and other administrative obligations. These third parties are all bound to confidentiality based on the agreement between them and us, or on the basis of an oath or legal obligation.

Automatically Collected Data

Data automatically collected by our website are processed for the purpose of further improving our services. These data (for example your IP address, web browser, and operating system) are not personal data.

Cooperation in Fiscal and Criminal Investigations

In certain cases, Berbersmudge may be required by law to share your data in connection with fiscal or criminal investigations by government authorities. In such a case, we are compelled to share your data, but we will oppose this within the possibilities offered to us by law.


Retention Periods

We retain your data as long as you are a client of ours. This means that we keep your customer profile until you indicate that you no longer wish to use our services. If you inform us of this, we will also interpret this as a request to be forgotten. This also means that we do not retain your data for longer than two years from the last contact moment or transaction, unless there is a legal justification for doing so. Based on applicable administrative obligations, we are required to retain invoices containing your (personal) data; we will therefore keep these data for as long as the applicable term runs. However, employees will no longer have access to your customer profile and documents that we have produced in response to your assignment.


Your Rights

Under applicable Dutch and European legislation, you as a data subject have certain rights regarding the personal data processed by or on our behalf. Below we explain what these rights are and how you can invoke them. In principle, to prevent misuse, we send copies and transcripts of your data only to the email address already known to us. If you wish to receive the data at another email address or, for example, by post, we will ask you to identify yourself. We keep records of completed requests; in the event of a request to be forgotten, we record anonymized data. You will receive all copies and transcripts of data in the machine-readable data format that we use within our systems. You have the right at all times to file a complaint with the Dutch Data Protection Authority if you suspect that we are using your personal data incorrectly.

You always have the right to inspect the data that we process, or have processed, that relate to your person or can be traced back to you. You may submit a request to that effect to our privacy contact person. You will then receive a response to your request within 30 days. If your request is granted, we will send a copy of all data to the email address known to us, together with an overview of the processors who have these data in their possession, stating the category under which we have stored these data.

You always have the right to have the data that we process, or have processed, that relate to your person or can be traced back to you adjusted. You may submit a request to that effect to our privacy contact person. You will then receive a response to your request within 30 days. If your request is granted, we will send a confirmation to the email address known to us that the data have been adjusted.

Right to Restriction of Processing

You always have the right to restrict the data that we process, or have processed, that relate to your person or can be traced back to you. You may submit a request to that effect to our privacy contact person. You will then receive a response to your request within 30 days. If your request is granted, we will send a confirmation to the email address known to us that the data will no longer be processed until you lift the restriction.

Right to Data Portability

You always have the right to have the data that we process, or have processed, that relate to your person or can be traced back to you transferred by another party. You may submit a request to that effect to our privacy contact person. You will then receive a response to your request within 30 days. If your request is granted, we will send transcripts or copies of all data about you that we have processed or that have been processed on our behalf by other processors or third parties to the email address known to us. In all likelihood, in such a case, we will no longer be able to continue our services, because the secure linking of data files can then no longer be guaranteed.

Right to Object and Other Rights

In appropriate cases, you have the right to object to the processing of your personal data by or on behalf of Berbersmudge. If you object, we will immediately cease the data processing pending the handling of your objection. If your objection is justified, we will provide you with copies and/or transcripts of the data that we process or have processed and then permanently cease the processing.

You also have the right not to be subject to automated individual decision-making or profiling. We do not process your data in such a way that this right applies. If you believe that this is the case, please contact our privacy contact person.


Cookies

Google Analytics

Cookies from the American company Google are placed through our website as part of the “Analytics” service. We use this service to track and obtain reports on how visitors use the website. This processor may be required under applicable laws and regulations to provide access to these data. We have not allowed Google to use the obtained analytics information for other Google services.

If third-party software solutions use cookies, this is stated in this privacy statement.


Changes to the Privacy Policy

We reserve the right to change our privacy policy at any time. However, you will always find the most recent version on this page. If the new privacy policy has consequences for the way in which we process data already collected concerning you, we will notify you by email.
